These Terms & Conditions ("Terms") govern your access to and use of the TravelMindsAI website, API, and related services (collectively, the "Services"). The Services are operated by TravelMindsAI ("we", "us", or "our"). By creating an account, accessing the API, or completing a purchase, you agree to these Terms.

1. Eligibility and account

You must be at least 18 years of age and able to form a legally binding contract to use the Services. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account.

2. License to use the Services

Subject to these Terms and your payment of any applicable fees, we grant you a non-exclusive, non-transferable, revocable license to access the API and the data exposed through it solely for your internal business purposes or within your end-user product. You may not:

• Resell, sublicense, or redistribute the raw data outside your product;
• Reverse engineer the Services or any rate-limiting, license-filter, or fraud-control mechanism;
• Use the Services to build a substantially similar travel-data API and offer it to third parties;
• Use the Services in violation of applicable law, including export controls, sanctions, and data-protection laws.

3. Source data and licenses

Our dataset is assembled from a mix of permissively licensed sources (Wikidata, Wikipedia, Wikivoyage, GeoNames, OpenStreetMap, UNESCO, and similar) and third-party providers under specific commercial licenses (such as Foursquare and Michelin). Each row exposed through the API carries source and license attribution. You agree to reproduce the required attribution where the underlying license requires it.

4. Acceptable use

You agree not to use the Services to:

• Generate misleading content presented as fact without grounding;
• Send unsolicited messages, including any form of spam or scraping at scale beyond your plan limits;
• Process personal data in a way that would require us to act as a data processor without a separate signed agreement;
• Build models or features that compete directly with the Services as a wholesale dataset.

5. Subscriptions, billing, and renewals

Paid plans are billed in advance on a monthly or annual cycle. You can upgrade, downgrade, or cancel from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to the Services through that period. Pricing on this site is in US dollars; applicable taxes are added at checkout.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

6. Refunds

Paid subscriptions include a 30-day money-back guarantee from the date of your first invoice on a new subscription. The full refund process is documented in our Refund Policy, which forms part of these Terms.

7. Service availability

We aim for high availability but do not guarantee uninterrupted service on plans without a written SLA. Scheduled maintenance windows will be communicated in advance where practicable. For acknowledged extended outages, eligible customers receive a service credit or pro-rated refund as described in the Refund Policy.

8. Intellectual property

All proprietary content of the Services — including the curated dataset structure, scoring formulas, derived indices, narrative templates, and branding — is owned by TravelMindsAI or our licensors. Nothing in these Terms transfers ownership of that intellectual property to you.

9. Confidentiality

Each party agrees to keep the other's non-public information confidential and to use it only for the purpose of performing under these Terms. This obligation survives termination of your account.

10. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Travel data — particularly visa rules, safety advisories, and POI information — changes frequently; we recommend independent verification for time-sensitive decisions.

11. Limitation of liability

To the maximum extent permitted by law, TravelMindsAI's aggregate liability arising out of or related to these Terms shall not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits, even if advised of the possibility.

12. Indemnity

You agree to defend, indemnify, and hold harmless TravelMindsAI from any claim, demand, or damages arising out of your use of the Services in violation of these Terms or applicable law, including any third-party claims relating to content you produce using our data.

13. Termination

We may suspend or terminate your access if you breach these Terms, subject to a reasonable cure period for non-material breaches. You may terminate at any time by cancelling your subscription. Sections that by their nature should survive termination — including IP, confidentiality, disclaimers, limitation of liability, and indemnity — survive.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email to the address on your account at least 14 days before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Disputes shall be resolved in the courts of competent jurisdiction at our principal place of business, except where mandatory consumer-protection law gives you the right to bring a claim in your country of residence.
